Terms of service
Overview
Welcome to MedGluv. The terms “we,” “us,” and “our” refer to MedGluv. MedGluv operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you with access to disposable gloves, personal protective equipment, medical-use products, general-purpose supplies, and related products and services.
MedGluv is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, including our Privacy Policy, Refund Policy, and Shipping Policy, describe your rights and responsibilities when you visit, interact with, or purchase from our website.
Please read these Terms of Service carefully. They include important information about your legal rights and cover areas such as product use, warranty disclaimers, limitations of liability, shipping responsibility, and dispute terms.
By visiting, interacting with, accessing, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
Section 1 - Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or territory of residence, or that you are the age of majority and have given us your consent to allow any minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your name, business name, email address, billing information, payment information, shipping information, phone number, tax-exempt or resale documentation, or other account details.
You represent and warrant that all information you provide to MedGluv is accurate, current, complete, and that you have all rights necessary to provide this information. You agree to promptly update your account and other information as needed so we may complete transactions and contact you when necessary.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person or entity.
We reserve the right to refuse service, terminate accounts, remove or edit content, cancel orders, or limit access to the Services at our discretion, including where we believe information provided is inaccurate, incomplete, fraudulent, unauthorized, or in violation of these Terms.
Section 2 - Our Products
MedGluv sells disposable gloves, personal protective equipment, medical-use products, general-purpose products, and related supplies. Product suitability depends on the intended application, environment, user sensitivity, applicable regulations, workplace requirements, and product specifications.
It is your responsibility to review product descriptions, packaging, labeling, specifications, material information, certifications, warnings, and intended-use statements before purchase and use.
Unless expressly stated on the product page or product packaging, products should not be assumed to be sterile, surgical-grade, chemical-resistant, cut-resistant, chemotherapy-rated, food-safe, medical-grade, or suitable for any specific procedure, exposure, industry, workplace, or regulated use. Disposable products are intended for single use unless otherwise stated by the manufacturer.
Some products may contain natural rubber latex or other materials that may cause allergic reactions or sensitivities in certain users. Customers are responsible for reviewing product materials and warnings before purchase and use. If latex sensitivity is a concern, choose products specifically identified as latex-free or made from alternative materials such as nitrile, vinyl, or other synthetic materials.
We make reasonable efforts to provide accurate product information in our online store. However, product images, packaging, case quantities, colors, materials, country of origin, manufacturer packaging, specifications, certifications, and availability may vary or change without notice.
Colors, packaging, or product appearance may also differ from how they appear on your screen due to device type, monitor settings, lighting, photography, or display configuration.
We do not warrant that the appearance, packaging, suitability, or quality of any product or service purchased by you will meet your expectations or be the same as depicted, described, photographed, or rendered in our online store.
All product descriptions, pricing, and availability are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities of any product offered to any person, business, organization, geographic region, or jurisdiction on a case-by-case basis.
Section 3 - Orders
When you place an order, you are making an offer to purchase. MedGluv reserves the right to accept, decline, cancel, or limit your order for any reason at our discretion.
Your order is not accepted until MedGluv confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or change requests after an order is accepted or processing has begun.
If we do not accept an order, make a change to an order, cancel an order, or need additional information, we will attempt to notify you using the email address, billing address, shipping address, or phone number provided at the time the order was placed.
Product availability is not guaranteed. We reserve the right to limit quantities, cancel orders, correct pricing or availability errors, or contact you regarding substitutions, backorders, delays, or alternatives when an item is unavailable, discontinued, incorrectly listed, restricted, or delayed.
You represent and warrant that you are purchasing products for lawful use by yourself, your business, your organization, or your authorized end users. You agree not to resell, export, divert, alter, relabel, misuse, or use any products in violation of applicable laws, regulations, trade restrictions, manufacturer requirements, product labeling, safety warnings, or these Terms.
We reserve the right to refuse, cancel, or limit orders that we believe may violate applicable law, product restrictions, supplier requirements, export restrictions, fraud-prevention standards, payment rules, or these Terms.
Your purchases are subject to return, refund, replacement, or exchange solely in accordance with our Refund Policy.
Due to the hygienic and safety-sensitive nature of disposable gloves, PPE, and related products, certain items may be final sale and may not be eligible for return once shipped, opened, used, damaged, contaminated, altered, or removed from original packaging.
Section 4 - Business, Institutional, Tax-Exempt, and Resale Customers
Business, institutional, tax-exempt, resale, government, nonprofit, school, healthcare, or purchasing-department customers are responsible for providing accurate account information and any required exemption, resale, purchasing, or billing documentation before placing an order.
Tax-exempt or resale documentation must be submitted and approved before the applicable order is placed. Taxes charged at checkout may not be reversible after order processing if proper documentation was not provided in advance.
Purchase orders, credit terms, check payments, and institutional billing arrangements may be accepted only at MedGluv’s discretion and may require approval before an order is processed. Unless otherwise agreed in writing, orders must be paid in full before processing or shipment.
Section 5 - Prices and Billing
Prices, discounts, promotions, and availability are subject to change without notice.
The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email, unless the price was listed in error.
Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs duties, import charges, brokerage fees, insurance, hazardous-material fees, address correction fees, delivery appointment fees, liftgate fees, inside delivery fees, storage fees, or other carrier or logistics charges.
Prices posted in our online store may differ from prices offered in physical stores, third-party marketplaces, quotes, catalogs, printed materials, supplier materials, or other online stores.
We may offer promotions from time to time that affect pricing. Promotions may be governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern for that promotion only.
You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases made through our store.
You represent and warrant that:
- The payment information you provide is true, correct, and complete;
- You are duly authorized to use the payment method provided;
- Charges incurred by you will be honored by your credit card company, bank, or payment provider; and
- You will pay all charges incurred by you at the posted or confirmed prices, including shipping, handling, taxes, and any applicable fees.
We reserve the right to cancel or hold orders due to suspected fraud, payment issues, billing discrepancies, verification concerns, pricing errors, inventory errors, or unusual order activity.
Section 6 - Shipping and Delivery
Delivery dates, shipping speeds, and transit times are estimates only and are not guaranteed.
Expedited shipping, when available, applies to carrier transit time only and does not necessarily reduce order processing time.
We are not liable for shipping or delivery delays caused by carriers, customs processing, weather, labor disruptions, supply-chain interruptions, incorrect addresses, restricted delivery locations, manufacturer delays, acts of God, security issues, payment holds, fraud review, or events outside our reasonable control.
Customers are responsible for providing a complete, accurate, and deliverable shipping address. We are not responsible for delays, delivery failures, address correction fees, carrier return fees, lost packages, additional shipping charges, or reshipment costs caused by incorrect, incomplete, undeliverable, closed, restricted, or inaccessible delivery addresses.
Once products are transferred to the carrier, title and risk of loss pass to you, unless otherwise required by applicable law.
Customers are responsible for inspecting shipments promptly upon delivery. Any missing, damaged, defective, or incorrect items must be reported to MedGluv within five business days of delivery, with photos of the product, packaging, shipping label, packing materials, and any visible damage.
Failure to report shipment issues within this timeframe may limit our ability to provide replacement, refund, credit, or carrier claim assistance.
If a shipment is refused, returned to sender, abandoned, undeliverable, or unclaimed, you may be responsible for original shipping charges, return shipping charges, carrier fees, storage fees, restocking fees, and any reshipment costs.
Section 7 - Returns, Refunds, and Replacements
Returns, refunds, replacements, and exchanges are governed by our Refund Policy.
All return requests must be approved by MedGluv before any product is returned. Unauthorized returns may be refused, returned to sender, or discarded without refund or credit.
Products must be returned in accordance with our return instructions and must include any required return authorization number, documentation, photos, or other information requested by MedGluv.
Due to hygiene, contamination, safety, regulatory, and quality-control concerns, disposable gloves, PPE, and related products may be final sale and may not be eligible for return once shipped, opened, used, damaged, contaminated, altered, expired, removed from original packaging, or otherwise not in resalable condition.
Shipping charges, handling charges, expedited shipping charges, freight charges, and special-service fees are non-refundable unless otherwise stated in our Refund Policy or required by law.
Section 8 - Product Use, Safety, and Compliance
MedGluv does not provide medical, clinical, regulatory, infection-control, occupational safety, chemical-safety, legal, or professional advice.
Any product information provided through the Services is for general informational and purchasing purposes only. Customers are responsible for determining whether a product is appropriate for their intended use and compliant with applicable workplace, healthcare, food-service, tattoo, salon, spa, sanitation, safety, OSHA, FDA, state, local, industry, institutional, or other regulatory requirements.
You agree to use all products only in accordance with applicable instructions, warnings, labeling, manufacturer specifications, and applicable laws or regulations.
MedGluv is not responsible for injuries, losses, contamination, exposure, allergic reactions, compliance failures, workplace incidents, regulatory violations, or other damages resulting from product misuse, improper selection, improper storage, improper handling, failure to follow instructions, failure to review product materials, or use in an application for which the product is not suited.
Section 9 - Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, product information, page layouts, design, selection, and arrangement thereof, are owned by MedGluv, its affiliates, suppliers, licensors, or service providers and are protected by U.S. and foreign patent, trademark, copyright, trade dress, and other intellectual property laws.
These Terms permit you to use the Services for lawful purchasing, informational, and account-management purposes only.
You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, scrape, copy, transmit, sell, resell, exploit, or otherwise use any material from the Services without our prior written consent, except as expressly permitted by these Terms.
Nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, trade secret, trade dress, or other intellectual property of MedGluv, Shopify, our suppliers, our licensors, or any third party.
MedGluv’s names, logos, product names, service names, designs, and slogans are trademarks of MedGluv or its affiliates or licensors. You must not use such trademarks without prior written permission from MedGluv.
Shopify’s name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans on the Services are the trademarks of their respective owners.
Section 10 - Optional Tools
You may be provided with access to customer tools offered by third parties as part of the Services. We neither monitor nor have control over such third-party tools.
You acknowledge and agree that we provide access to such tools “as is” and “as available,” without warranties, representations, or conditions of any kind and without endorsement.
We shall have no liability arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party providers.
We may, in the future, offer new features through the Services, including the release of new tools and resources. Such new features shall also be deemed part of the Services and are subject to these Terms of Service.
Section 11 - Third-Party Links
The Services may contain materials, references, or hyperlinks to websites, tools, platforms, or resources provided or operated by third parties, including embedded third-party functionality.
We are not responsible for examining or evaluating the content, accuracy, availability, practices, policies, products, or services of any third-party materials or websites.
If you decide to leave the Services to access third-party materials or websites, you do so at your own risk.
We are not liable for any harm, loss, or damages related to your access of third-party websites or your purchase or use of any products, services, resources, or content on third-party websites.
Please review third-party policies and practices carefully before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.
Section 12 - Relationship With Shopify
MedGluv is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our store are made directly with MedGluv.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MedGluv, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MedGluv.

We may use Feedback to operate, provide, evaluate, enhance, improve, and promote the Services, products, and MedGluv business.

You agree that your Feedback will not violate the rights of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights.
You may not use a false email address, pretend to be someone else, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you provide and its accuracy.
Section 15 - Errors, Inaccuracies, and Omissions
Occasionally, information on or through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, product images, specifications, certifications, pricing, promotions, offers, shipping charges, transit times, availability, case quantities, packaging, materials, or other information.
We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Services or in any related communication is inaccurate at any time without prior notice, including after you have submitted an order.

Section 17 - Agents and Automated Access
This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services.
“Agent” means any software, bot, crawler, scraper, automated tool, AI system, autonomous or semi-autonomous service, or other technology that takes action on behalf of, or at the instruction of, any person or entity and can be executed without direct human supervision.
No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with this section.
We may limit, restrict, block, or otherwise control whether and how any Agent accesses, uses, or interacts with the Services, including by technical measures.

We may terminate this agreement or your access to the Services, or any part of the Services, at our sole discretion at any time without notice.
You will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Product Use, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
Section 19 - Disclaimer of Warranties
The information presented on or through the Services is made available for general informational and purchasing purposes only.
We do not warrant the accuracy, completeness, reliability, suitability, or usefulness of any information on the Services. Any reliance you place on such information is strictly at your own risk.
MedGluv does not provide medical, clinical, regulatory, occupational safety, infection-control, chemical-safety, legal, or professional advice.
Customers are solely responsible for determining whether a product is appropriate for their intended use, industry, procedure, workplace, client, patient, employee, exposure type, or regulatory environment.
Except as expressly stated by MedGluv in writing, the Services and all products offered through the Services are provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied.
To the fullest extent permitted by law, MedGluv disclaims all warranties and conditions, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, non-infringement, accuracy, availability, and suitability.
We do not guarantee, represent, or warrant that your use of the Services will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components.
We do not guarantee that any product will prevent exposure, infection, contamination, injury, allergic reaction, chemical exposure, puncture, failure, regulatory violation, or other harm.
Some jurisdictions limit or do not allow the disclaimer of implied or other warranties, so some of the above disclaimers may not apply to you.
Section 20 - Limitation of Liability
To the fullest extent permitted by law, in no case shall MedGluv, Shopify, or our respective partners, directors, officers, employees, affiliates, agents, contractors, suppliers, manufacturers, distributors, service providers, licensors, or representatives be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, exemplary, or consequential damages of any kind.
This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, loss of business opportunity, business interruption, replacement costs, procurement costs, reputational harm, regulatory penalties, exposure claims, contamination claims, allergic reactions, workplace incidents, or similar damages.

Section 21 - Indemnification
You agree to indemnify, defend, and hold harmless MedGluv, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, suppliers, manufacturers, distributors, service providers, and representatives from any losses, damages, liabilities, costs, claims, demands, judgments, settlements, penalties, fines, and expenses, including reasonable attorneys’ fees, arising out of or related to:

- Any information, content, or Feedback you provide; or
- Any activity under your account.
We will notify you of any indemnifiable claim, provided that failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced.
We may control the defense and settlement of any claim at your expense, including choice of counsel, but we will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld.
You agree to cooperate in the defense of indemnified claims, including by providing relevant documents and information.
Section 22 - Severability
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.
The unenforceable portion shall be deemed severed from these Terms of Service, and such determination shall not affect the validity and enforceability of any remaining provisions.
Section 23 - Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and MedGluv and govern your use of the Services.
These Terms supersede any prior or contemporaneous agreements, communications, proposals, or understandings, whether oral or written, between you and MedGluv, including any prior versions of these Terms.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Section 24 - Assignment
You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. Any such attempt will be null and void.
We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice.
Section 25 - Governing Law
These Terms of Service and any separate agreements whereby we provide Services shall be governed by and construed in accordance with the laws of the State of Florida], without regard to conflict-of-law principles.
